SCOOTERBUG INC.
TERMS AND CONDITIONS OF USE
SCOOTERBUG INC. OFFERS SHORT TERM RENTAL/LETTING OF EQUIPMENT NAMED ON THE RENTAL AGREEMENT TO THE GUEST WHOM ACKNOWLEDGES AND AGREES TO THE TERMS AND CONDITIONS SET OUT BELOW.
1. Equipment. The rental equipment is the property of ScooterBug Inc. and is in good condition. Renter will return the rental equipment in the same condition as when received, at the end of the rental period for inspection and recharge of battery (if necessary), or sooner, upon the demand by ScooterBug Inc.. ScooterBug Inc. may repossess the rental equipment without demand at any time if it is used in violation of the terms of this agreement.
2. Cancelation. Renter may cancel their reservation 48 hours prior to delivery at no cost to the Renter. In the event Renter cancels this order after 48 hours from the reserved rental period Renter will be charged a cancellation fee of $30.00 per rental device. The Renter will be charged the full rental amount should they fail to cancel the reservation prior to delivery. Reservations may be canceled online at www.scooterbugmobilityrentals.com or by calling 1-800-726-8284.
3. Liability. The Renter is liable or responsible for the loss of or damage to any property, equipment left, lost, damaged, stolen, stored or transported by Renter, its agents, servants, or employees, or any other person on the scooter, either before or after the return thereof to ScooterBug Inc. Renter assumes all risk of such loss or damage and waives all claims against ScooterBug Inc. by reason thereof and Renter agrees to hold ScooterBug Inc. harmless from and to defend and indemnify ScooterBug Inc. against all claims based upon or arising out of such loss or damage.
3.1. Renter assumes all risk and liability for any loss, damage or injury, including death, to persons or property of Renter or others arising out of the use, operation or driving of the rental equipment.
3.2. If the Renter chooses to decline the damage waiver the Renter will reimburse ScooterBug Inc. for the full cost of replacement upon demand for any damage, loss, theft, or destruction of the rental equipment. The Renter understands and authorizes that ScooterBug Inc. will charge the credit card used for any repair costs or the replacement costs of the rental equipment. Damage waiver does not cover equipment that is lost or stolen.
3.3. ScooterBug Inc. assumes no liability or responsibility for any acts or omissions of Renter or of Renters agents, servants, or employees.
4. Restrictions. The following restrictions are cumulative and each shall apply to every use, operation or driving of the rental equipment. Under no circumstances shall the rental equipment be used, operated by any person: a) under the age of 18; or b) while under the influence of intoxicants or narcotics; or c) in an unsafe manner. The renter must provide ScooterBug, Inc. with an accurate representation of their weight prior to completion of their reservation. Weight must not exceed rental equipment weight limitations. Customer will not give or transfer possession of the equipment to anyone else and the equipment shall not be transported out of Orlando, Florida, without express written consent from ScooterBug. The equipment shall be returned to Return Location unless arrangements have been made directly with ScooterBug.
5. Claims. Renter shall defend, indemnify and hold harmless ScooterBug Inc., all of their agents, officers, servants, and employees from and against any and all losses, liability claims, damages, injuries, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage or injury claimed by persons that may arise from the use, operation or driving of the rental equipment, provided that such loss or damage was not caused by the fault or gross negligence and willful misconduct of ScooterBug Inc. or its employees.
6. Fees. Renter
assumes all costs and expenses of every kind and nature, including legal fees
and disbursements arising out of and in connection with the use, operation or
driving of the rental equipment.
7. ECV Renter Operation. Renter
shall require drivers to operate the scooter with reasonable care and diligence
and comply with the terms of this agreement. Renter shall notify ScooterBug
Inc. immediately of any and all accidents and damage resulting from the use,
operation or driving of the rental equipment.
8. Renter Costs. Renter agrees to
pay all costs, expenses, and attorneyÕs fees incurred by ScooterBug Inc. in collecting sums due or in regaining possession
of rental equipment or in enforcing or recovering any damage, losses or claims
against Renter.
9. Renter to ScooterBug Agreement. Renter or the driver of the rental equipment shall in no
event be deemed the agent or employee of ScooterBug Inc. in any manner or for
any purpose whatsoever.
10. Agreement. Any
individual executing this Agreement as Renter in a representative capacity
shall be bound personally, jointly and severally, with such fiduciary,
corporation or other entity as to all obligations, expressed or implied,
arising hereunder.
11. DISCLAIMER. IF ANY
PROVISIONS HEREOF OR THE APPLICATION OF ANY PROVISIONS TO ANY PERSON OR
CIRCUMSTANCE IS HELD INVALID OR UNENFORCEABLE, THE REMAINDER HEREOF AND THE
APPLICATION OF SUCH PROVISION TO OTHER PERSONS OR CIRCUMSTANCES SHALL REMAIN
VALID AND ENFORCEABLE.
CREDIT AND DEBIT CARD POLICIES
i.
ScooterBug Inc. accepts most major credit cards as credit
identification and payment at the time of rental.
ii.
ScooterBug Inc. reserves the right, in its sole discretion, to
seek a Debit Card authorization hold of the estimated rental charges. When
using a debit card at ScooterBug Inc.
iii.
If you fail to return the rental equipment as agreed, ScooterBug
Inc. will obtain additional authorizations from your account to cover the
rental charges and the balance value of the scooter.
iv. ScooterBug Inc. is not responsible for any returned checks or over-drafts based on this policy.
v.
Positive identification in addition to your driver's license may
be required.
Note: Prepaid Debit/Gift cards are not acceptable methods of credit
identification. One of the above mentioned cards must be presented.
Damage Waiver Terms and Conditions
The optional damage waiver is not an insurance policy. The waiver covers only damage to the equipment up to the amount of $500. Any damage that exceeds this amount will be charged directly to the renter. The renter is not responsible for minor wear and tear damage such as paint scuffs or scratches. Should the renter decline the damage waiver, then he/she would be responsible for all damage that may occur to the rental equipment.
RENTAL EXTENSIONS
Scooters are due back at the date/time specified on the rental agreement. If you need to extend your rental, please call us prior to expiration at 1-800-726-8284.
WARNINGS
USE CAUTION when operating the unit in bad weather or driving through water; as moisture could affect the control system or other parts of the unit and cause damage.
OPERATOR MUST REMAIN SEATEED with the seat locked in the forward position.
ALWAYS read operating manual and all warning labels prior to operating equipment.
ALWAYS use extreme caution when entering or exiting an elevator.
ALWAYS keep arms and legs within confines of the unit.
ALWAYS lean forward in the seat when traveling up an incline.
ALWAYS make sure the Key Switch is either removed before transferring ON and OFF the vehicle.
ALWAYS reduce speed and use extreme caution when operating indoors or in crowded areas.
ALWAYS remember that vehicle capacity is limited to one (1) person ONLY. This unit is not approved for towing or for weights in excess of the published maximum.
ALWAYS turn the power OFF when not in use. This will keep the unit from being accidently moved.
ALWAYS reduce speed when making a turn.
ALWAYS use extreme caution when operating near or around electromagnetic equipment such as cellular phones and ham radios.
ALWAYS use extreme caution when operating on sidewalks or uneven surfaces.
ALWAYS reduce speed before making a turn.
DO NOT carry passengers.
DO NOT turn the key on until you are properly seated with your feet on the floor.
DO NOT operate unless the seat is locked and facing forward.
DO NOT get off the unit until you have turned OFF the key switch. Remove the key when the unit is unattended.
DO NOT make sharp turns while traveling at high speeds or when operating on inclines and/or uneven surfaces.
DO NOT operate if the parking brake is not working properly.
DO NOT operate when carrying a weight that exceeds weight limitations.
DO NOT operate that unit until you are a confident of your ability to do so safely.
DO NOT allow the unit to get wet.
DO NOT ride over curbs or other obstructions higher than three (3) inches.
DO NOT stop on an incline. If you must do so, always lean forward when you begin moving. This will shift the center of gravity to prevent the unit from tipping over backwards.
DO NOT climb inclines that pose a concern for stability.
DO NOT turn the key switch OFF while the unit is moving. This will cause the brake to activate causing the unit to stop abruptly.
DO NOT attempt to get off of the unit while it is moving.
DO NOT operate the equipment while under the influence of alcohol or narcotics.
DO NOT remain seated on the equipment while it is being transported.
DO NOT climb inclines greater than the 25%; (1 inch rise over a 4 inch distance). ALWAYS drive straight up and down when on inclines.
NEVER attempt to negotiate stairs or escalators with the equipment.
NEVER have speed control set to more than half of maximum when indoors
